Lawyers and Other Professionals – Win Your Divorce

Lawyers and Other Professionals – Win Your DivorceHow many professionals are you going to need to divorce and move forward? Divorce can be complicated with more than one professional needed to cover everything from negotiating a settlement to selling the house.

Most people start their divorce proceedings by going straight to a lawyer which is not unwise, the logical place to start is to understand your legal rights and obligations. The right lawyer will give you their opinion on how your divorce will play out, a ball park figure on how much money you can expect in a split, what you might expect for child custody arrangements and also different avenues to be considered for a fast and calm divorce.

The choice now becomes whether to start legal action or try another avenue which may be cheaper and less antagonistic. Mediation has become extremely popular of late with many states and family courts requesting mediation is tried, in earnest, before a legal case can be put forward. Mediation works for many people, even if settlements are reached in a few areas. Many people find mediation works well for reaching agreement on parenting plans, as being able to discuss what works and what doesn’t with a mediator making sure the conversation stays polite. Choosing a mediator is as important as choosing any professional, you must feel some rapport and trust that the mediator will be impartial and not judge. Before agreeing to a mediator have a introductory meeting to understand their methods, their opinions and their expected outcomes, then decide.

A divorce coach can be an alternative starting point for divorce proceedings. People are starting to realise that getting and keeping their emotions under control, understanding the reality of their situation, making plans for the future, figuring out exactly what they want and need to move forward is just as important as the legal settlement. It can be extremely calming to have an understanding of how the future could look instead of, like most divorcees, be looking back to what is lost. A good divorce coach will be able to partner a client through every aspect of the divorce. Often someone going through divorce can only see things one way, a divorce coach will help a person see many options that could be taken.

When there are children issues a child specialist may be called upon to assess the children of a marriage. This can be daunting not only for the children but also for the parents who feel under attack when their parenting skills are being called into account. A child specialist is usually a therapist of some kind who specialises in the welfare of children. In the divorce arena the child specialist can become the voice of the child so to speak. The child specialist’s only interest is the welfare of the child. When hiring a child specialist be aware of the above and do not try to play games or disparage your ex in front of the child specialist, it will not go in your favour.

The Collaborative team is another alternative to a legal litigation. Collaborative teams are made up of two lawyers, two divorce coaches, a financial expert and a child expert. Together they partner the couple through the divorce process with the written understanding that the divorce will not end up in court. If for any reason the couple decides to litigate then the Collaborative Team will walk away and the couple will have to start again with new lawyers and any other new advisers they wish. A Collaborative team is usually put together by the professionals. The couple usually hires one of the Collaborative team as a starting point.

Going through divorce is daunting for everyone. Understanding the options for a divorce is empowering for a couple when they are just about to make fundamental changes to their lives. Control seems to be slipping but knowing that the option for how the divorce will play out can help make it more amicable as both parties feel a little more in control.
